These Terms of Service ("Terms") govern your use of DrayageScanner (the "Service") operated by Talya Global Lojistik Hizmetleri ("we", "us", "our"). By creating an account or otherwise using the Service you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. Accounts must be registered with accurate information and used by the person or organisation named at registration.
2. Accounts and security
You are responsible for safeguarding your password and for any activity that occurs under your account. Notify us at info@talyasmart.com immediately if you suspect unauthorised access.
3. The Service
DrayageScanner aggregates drayage rates, terminal appointment availability, chassis pool status, container move events and carrier metadata from third-party carriers, terminals and data providers. The data is provided on a best-effort basis and may contain inaccuracies or lag behind the source.
Time-critical information must be verified at the source. Appointment slots, last free day, terminal gate hours, empty-return acceptance and demurrage exposure change without notice and are controlled by the terminal or ocean carrier, not by us. Confirm them directly before acting.
4. Our role in a booking
We are a technology platform that connects you with licensed motor carriers. Unless we state otherwise in writing for a specific move, we are not the carrier, we do not take custody of your cargo, and we do not act as your customs broker. Carriage is performed by the carrier you book under that carrier's own terms, tariff and insurance. Claims for loss, damage, detention or delay lie against the performing carrier; we will help you route and document them.
5. Acceptable use
You agree not to:
- Reverse-engineer, scrape or systematically download Service data beyond your subscription quota.
- Resell, sublicense or re-publish rate, appointment or terminal data without a written commercial agreement.
- Book or automate appointment slots you do not intend to use, or otherwise abuse terminal appointment systems.
- Use the Service to move cargo that is illegal under applicable export-control, sanctions, hazmat or dual-use regulations.
- Probe, scan or test the vulnerability of the Service without written authorisation.
- Use the Service in a way that overloads our infrastructure or degrades it for other users.
6. Subscription, fees and renewal
Paid plans are billed monthly in advance through our payment gateway. Subscriptions renew automatically until cancelled from your account billing page. Quotas (booked container moves, rate searches, appointment lookups, tracking calls) reset on the first day of each calendar month at 00:00 UTC.
Subscription fees are separate from the cost of carriage. Amounts you pay a carrier for a move, and any accessorials the carrier or terminal assesses (chassis, pre-pull, waiting time, congestion, per diem, demurrage), are not subscription fees and are not refundable by us.
Prices may change. We will give at least 14 days' notice for any price increase that affects your subscription, by email and through an in-app banner.
7. Cancellation
There is no free tier. All plans are paid and start at $1.99/month (Starter). You may cancel at any time from your billing page — cancellation stops future renewals, and your access continues until the end of the current paid period. We do not provide pro-rated refunds for partial months. We may rate-limit, suspend or withdraw access without notice if we detect abuse, automation, sustained over-quota use or fraudulent payment activity.
8. Intellectual property
DrayageScanner, the DrayageScanner mark, the platform UI, brand assets, code, documentation and the curated databases we maintain (port and terminal registry, carrier registry, lane benchmarks) are our intellectual property or that of our licensors. Carrier and terminal logos, names and trademarks shown on the Service remain the property of their respective owners and are used for informational reference only.
9. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted availability. We do not guarantee that the Service will be error-free, that an appointment shown as open will still be open when you book it, or that the underlying carrier and terminal data will be complete or current.
10. Limitation of liability
To the maximum extent permitted by applicable law our aggregate liability arising out of or related to the Service will not exceed the greater of (a) the subscription fees you paid us in the twelve (12) months immediately preceding the event giving rise to the claim or (b) one hundred US dollars (USD 100). We are not liable for indirect, incidental, special, consequential or punitive damages, including per diem, demurrage, detention, storage, loss of profit, cargo, revenue, goodwill or data.
11. Termination
You may cancel your account at any time from the billing page or by emailing us. We may suspend or terminate your account if you breach these Terms, if your payment fails after reasonable notice, or if continuing to serve you would expose us to legal risk. On termination you lose access to paid features; we will keep your account record for the period required by law and then delete it.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or a prominent in-app banner at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
13. Governing law and venue
These Terms are governed by the laws of the Republic of Türkiye. Any dispute that cannot be resolved through good-faith negotiation will be submitted to the exclusive jurisdiction of the courts and execution offices of Istanbul (Çağlayan), Türkiye.
